Update October 22: He Has a Lawyer Now
Rafael has an immigration attorney, and she is on her way to him.
That is the headline of this day, and after the night we had, it is enough to lead with. Yesterday evening, October 21, 2026, ICE took my son-in-law off a plane in St. Louis and put him in the Ste. Genevieve County Detention Center in Missouri. This morning he has counsel. She will be introduced to Rook, who is keeping this case's records around the clock, and she will get the full briefing we have built. The family keeps demanding the same three things in writing: the warrant, the charge, and a court case.
Because here is where the paper stands, still, and it is worth saying plainly what each piece means.
No warrant has been produced. The agents said there was one. Nobody has ever shown it to Rafael or to us, and it does not appear in any public system we have searched: the ICE detainee locator, Missouri state courts, the Broward County clerk, federal court records, and the Florida wanted persons list. If a warrant exists at all, it can only be an internal ICE form signed by an ICE officer, not an order signed by a judge.
No charge has been filed. In immigration enforcement the charge is a paper called a Notice to Appear, and it is the document that says what the government claims a person did. Nobody has given one to Rafael or to this family. We cannot even read what the government alleges, because the government has not written it down anywhere we can reach.
No court case exists. The immigration court, EOIR, was checked by Rafael's own A-number, the government's file number for him. The answer was: no case found for this A-number. An immigration court case only exists once ICE files the Notice to Appear with the court, and ICE has not filed it. So the detention system has him, and the court system has never heard his name. There is no judge, no file, and no hearing date. A man can be held and moved inside that gap without any judge ever seeing a single page, and that gap is why we are forcing the paper into the open.
What got filed today, October 22, 2026: a Freedom of Information Act request to ICE for the arrest records, filed by Rook as requester, in writing, by email. ICE's portal wanted a registered account; the statute does not require one, so we did it the way the law allows. A paper copy by certified mail is planned; it has not been mailed, and I am not going to pretend otherwise. Also today: a second Missouri Sunshine Law request to the Sheriff of Ste. Genevieve County, for the duty roster of October 21, the names of the two employees who spoke on our call that night at 8:43 PM Central, a call of 4 minutes and 14 seconds that ended when the supervisor hung up, and the night's call and dispatch logs.
His documented position, for anyone just arriving: Rafael is a Colombian national, married to my daughter, a United States citizen, on May 4, 2026. He entered through an inspected admission at Miami on July 13, 2021, on a B1/B2 visa that is valid through June 2027. His own asylum application has been pending with USCIS since 2022, biometrics completed April 14, 2022. Nothing granted, nothing hidden: pending, and documented.
The ask has not changed. If you know something about this arrest, or you are an immigration attorney or have one specific attorney lead, send it once to rafael@thelogfile.com. If you want to leave him and his family a message, there is a wall for that now, and it will be kept: https://thelogfile.com/rafael/wall/
