They Took My Son-in-Law Tonight

My son-in-law, Rafael Nuñez Penna, got off a plane in St. Louis this evening a little before 6 PM Central, and ICE agents were waiting for him. They told him they had a warrant. He was handcuffed, and tonight he is in the Ste. Genevieve County Detention Center in Ste. Genevieve, Missouri, about an hour south of the airport.

He got one phone call out. He used it to call me. He told me where they were taking him, and he told me he did not know what the warrant was. Since that call, his wife has not been able to reach him, and none of us can call in.

I am his father-in-law. I watched him marry my daughter this spring. He came to this country as a boy, with his family, under political asylum. He is married to a United States citizen. His family's asylum paperwork is being gathered tonight, and his mother is engaging a lawyer, because her partner was also arrested by ICE tonight.

Here is what we have done tonight, because I believe in paper.

We searched for the warrant they claimed. ICE's own detainee locator has no record of him. Missouri's courts have no case against him. The federal court archive has no case in his name. Florida's wanted persons database, in his home state, says no wanted persons found. If ICE holds a warrant, they have not produced it, and they have given us no charge and no A-number. They will be asked again in the morning, in person and in writing.

We have written to ICE's Chicago field office and to the jail administrator. We have filed a Missouri Sunshine Law demand with the Sheriff for his booking record, for whatever detainer or warrant sits in his file, and for the recording of the call my wife and I made to that jail tonight. A federal FOIA request is filed. We have asked, in writing, that he be allowed to call his wife tonight, that he be given the free legal hotlines detainees can dial, and that his rights be read to him in Spanish.

He has a medical appointment tomorrow, October 22. That is flagged in writing to ICE and to the jail.

What we need is simple. A detention attorney in the St. Louis or eastern Missouri area who can move in the morning. His asylum documents in one place. And for ICE to produce the paper it says it has.

The jail's offices open at 8 AM Central. I will be in the area. The record of tonight is public, and it will keep growing until he is home.
